She had unsuccessfully appealed to a tribunal with the help of a private practice solicitor. The Law Centre took the case to the Social Security Commissioner and also recommended that she make a fresh claim. This case involved the common issue of how a tribunal should handle weighing of medical evidence where there is a conflict between that of the GP and the Examining Medical Practitioner (EMP). The Tribunal had decided to follow the evidence of the EMP over the GP’s report.
